On line sales general conditions (11/2017)
The present conditions of sale are concluded between the company SOBRE named hereafter “the salesman” and any person or entity wishing to proceed to a purchase via the on-line shop of SOBRE www.sobreshop.com named hereafter “the purchaser”.
1 : Object
The present conditions of sale aim at defining the contractual relations between SOBRE and the purchaser and conditions applicable to any purchase carried out by the means of the on-line shop of SOBRE (www.sobreshop.com), whether the purchaser is professional or consumer. These terms are only applicable for new product, it will not be applied for second hand products.
The acquisition of a good through this site implies a general acceptance by the purchaser of these conditions of sale.
SOBRE reserves the right to be able to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the order by the purchaser.
2 : Goods characteristics
The products offered are those which appear in the catalogue published on the on-line shop of SOBRE, www.sobreshop.com.
These products are offered within the limit of stocks available.
A detailed description established by the supplier is available for each product on the on-line shop of SOBRE, www.sobreshop.com.
The photographs of the Internet site as well as on the on-line shop of SOBRE cannot ensure a perfect similarity with the product offered, in particular with regards to the colors.
3 : Prices
The prices in euro appearing in the on-line shop include all taxes, taking into account the VAT applicable to the day of the order; any change of the rate could be reflected on the price of the products, the current rate being presented on the on-line shop.
SOBRE reserves the right to modify its prices at any time; however the price appearing on the on-line shop on the day of the order will be the only one applicable to the purchaser.
The prices indicated do not include the expenses of treatment of orders, transport and delivery for foreign countries.
4 : Geographical areas
The on-line sale of the products presented on the on-line shop of SOBRE is reserved to the purchasers who reside in EU country and for deliveries in these geographical areas.
Any purchase outside of the EU will request a specific agreement from SOBRE, with regards to the shipping fees.
Any additional fee (custom fees) will be entirely charged to the purchaser.
5 : Purchases
The purchaser, who wishes to buy a product through the on-line shop of SOBRE must:
- fill in the identification card with all requested data, and provide his e-mail address;
- fill in the purchase order on line by the means of the catalogue and the basket by specifying for each one the quantity;
- validate its order after having checked it;
- confirm its order;
- carry out the payment under the conditions envisaged.
The confirmation of order involves acceptance of these conditions of sale, the recognition to have perfect knowledge of it and the renunciation to prevail itself of its own conditions of purchase or other conditions.
The whole of the provided data and the recorded confirmation will be worth proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out.
SOBRE will communicate by email the validated confirmation of order.
The information given by the purchaser when making an order it. If there is an error in the address of the recipient, the salesman can not be held to be responsible for failure to deliver the product.
In the case of new shipment due to incorrect address from the purchaser, delivery fees will be charged to him.
In case of error on the contents of the order, the purchaser should notify SOBRE by mail to get acceptance.
The return will be taken in charge by SOBRE.
6 : Payment terms
The price is exigible with the order.
The payments will be carried out via a securied payment server using credit card or via Paypal.
The order will be effective only when payment will be received.
An invoice mentioning the VAT will be enclosed with the products.
7 : Deliveries
The products will be delivered to the address mentioned in the purchase order provided the location is in the agreed geographical area.
The risks are the responsibility of the purchaser as from the moment when the products leave the SOBRE company.
The time to delivery will take four working days from the validation of the order for France. This time is almost one week for Europe.
SOBRE will not support the responsibility of any delay in the delivery linked to the conveyor.
SOBRE will not support the responsibility of any damage during transport; the purchaser will have to issue a reserve near the conveyor. The purchaser will have to send within two working days from the date of delivery, a letter with acknowledgement of receipt to the conveyor, exposing the damage and protest. The purchaser will have to forward a copy of his protest to: Sobre SARL – 34 rue du Chateau – 69640 Jarnioux.
In case a purchased product was not available whereas indicated as available on the site, SOBRE is committed of informing the purchaser by the means of the address email and/or telephone number completed on the purchase order.
8 : Product return
The purchasers, physical people nonprofessional, profit from a time of forteen days retractation as from the delivery of their order to return the product to the salesman for exchange or refunding within 30 days and without penalty, except for the expenses of return and provided the product is restored in the state and the packing in which it was dispatched.
In case of an exchange, the return and re-expedition expenses will be charged to the purchaser.
In the event of nonconformity of a product compared to the order, it could be returned within 7 days to the salesman who will exchange or refund it.
Any request for exchange or refunding must be addressed to SOBRE by email through the contact email address available on the SOBRE Internet or on-line sites.
Any return or exchange will only be accepted if products are return by postal freight with delivery with signature option in their original box in original condition without any mark of assembly or use.
9 : Warranty
All the products provided by the salesman profit from the legal warranty envisaged by articles 1641 and following of the Civil code, as well as by the articles L211-1 to L211-18 of the consumption code.
The SOBRE brand products profit from this warranty for two years from the purchase date, excluding particular conditions specified on product sheet or second hand product . This warranty does not cover any breakage or impact following a non-conform use of the product, nor any scratch or crackle of the paint following a usual mountain bike practice.
Any request for an application of the warranty must be addressed to SOBRE by email through the contact email address available on the SOBRE Internet or on-line sites.
10 : Responsibility
The salesman, in the process of sale on line, is held only by one obligation of means; its responsibility could not be committed for a damage resulting from the use of Internet network such as loss of data, intrusion, virus, rupture of the service, or other involuntary problems.
11 : Data in personal matter
In accordance with the law relating to data processing, the files and freedoms of January 6, 1978, SOBRE will not disclose any information in personal matter relating to the purchasers, nor transmit their customers file for commercial purpose.
12 : Filing - Proof
SOBRE will file the purchase orders and the invoices on a reliable and durable support constituting a faithful copy, in accordance with the provisions of article 1348 of the Civil code.
Computerized registers of SOBRE will be considered by the parts proof of the communications, orders, payments and transactions occurred between the parts.
13 : Payment of the litigations
The present conditions of sale on line are subjected to the French law and the court of the registered office.
